Terms and Conditions

These Terms and Conditions ("Terms") govern the legal services offered by A. Niki Mehan, Attorney at Law, doing business as Circle Law (the "Firm"), including the fixed-fee plans described below. By purchasing a Plan or engaging the Firm, the client ("Client") agrees to these Terms. These Terms are supplemented and superseded by the written engagement agreement executed by the Client and the Firm (the "Engagement Agreement"), which controls in the event of any conflict. The Firm may update these Terms at any time.

1. No Attorney-Client Relationship Through This Website

This website is provided for general informational purposes only and does not constitute legal advice. Viewing this website, or contacting the Firm through it, does not create an attorney-client relationship. An attorney-client relationship is formed only upon execution of a written Engagement Agreement by both the Client and the Firm. The Client should not send confidential or time-sensitive information to the Firm until such a relationship has been established.

2. Definitions

2.1 "Plan" means one of the fixed-fee service offerings described in Section 3.
2.2 "Flat Fee" means the fixed fee stated for a Plan, payable in advance.
2.3 "Standard Misdemeanor" has the meaning set forth in Section 4.
2.4 "Third-Party Costs" means costs charged by persons or entities other than the Firm, as described in Section 5.
2.5 "Engagement Agreement" means the written agreement executed by the Client and the Firm setting forth the specific scope of representation.

3. Plans and Scope of Services

The scope of each Plan is limited to the services expressly listed for that Plan and as further defined in the Engagement Agreement.

3.1 Attorney Case Review & Action Plan — $995. The Attorney Case Review & Action Plan is a limited-scope engagement. It includes: (a) Discovery — obtaining the Client's charging documents and taking steps to preserve evidence; (b) Case Intake; (c) Attorney Case Review — review of the Client's file by an attorney; (d) a one-on-one Action Plan session with an attorney, provided within three (3) days of the Firm's receipt of a complete file; (e) access to the Circle Defense Course; (f) the Court Confidence Kit; (g) the Resource Sheet; (h) the Bi-Weekly Group Educational Forum; (i) a commitment to respond to Client inquiries within forty-eight (48) hours; and (j) application of the $995 Flat Fee in full toward a representation Plan if the Client subsequently engages the Firm for one. This Plan does not include representation or appearance by the Firm at any court proceeding.

3.2 Full Service Representation — $6,250. Full Service Representation includes: (a) all services described in Section 3.1; (b) representation by the Firm at all court appearances in the trial court, other than trial; (c) motions, including a motion to suppress evidence and discovery motions; (d) investigation conducted by the Firm. Full Service Representation does not include trial, which is available under the Concierge Plan. Any $995 Flat Fee previously paid by the Client for the Attorney Case Review & Action Plan is credited in full toward this Plan.

3.3 Concierge Plan — $15,000. The Concierge Plan includes all services described in Section 3.2, representation at trial, and priority scheduling.

4. Standard Misdemeanor

The Flat Fees stated for the Attorney Case Review & Action Plan and Full Service Representation apply to Standard Misdemeanor matters; other matters are quoted individually. A "Standard Misdemeanor" means (a) a misdemeanor DUI (first, second, or third offense) with no additional charges, or (b) a single-count misdemeanor other than a DUI.

5. Third-Party Costs

The Flat Fee for each Plan covers only the services of the Firm. All Third-Party Costs are the responsibility of the Client and are billed at the rate charged by the third party, without markup. Third-Party Costs include, without limitation, expert witnesses, outside or specialized investigators, laboratory fees, court fees, and all other third parties.

6. Fees

Flat Fees are payable in advance. The Firm does not charge hourly fees for the services included in a Plan and does not seek additional fees from the Client for those included services.

7. No Guarantee of Outcome

The Firm makes no representation, warranty, or guarantee regarding the outcome of any matter. Prior results do not guarantee or predict a similar outcome in any future matter.

8. Disclaimers; Attorney Advertising

This website and its contents may be considered attorney advertising. The information provided is general in nature and is not legal advice.

9. Limitation of Liability

To the fullest extent permitted by applicable law, the Firm's liability arising out of or relating to these Terms or the Firm's services is limited as set forth in the Engagement Agreement. Nothing in these Terms limits any liability that cannot be limited under applicable law or the California Rules of Professional Conduct.

10. Governing Law

These Terms are governed by the laws of the State of California.

11. Changes to These Terms

The Firm may update these Terms at any time. The Terms in effect when the Client executes an Engagement Agreement govern that engagement, and the Engagement Agreement supersedes these Terms.
